1. The Service

FadeChats ("the Service", "we", "us") is an ephemeral two-person chat web application. Communication happens directly between participants via WebRTC peer-to-peer data channels. The Service does not store message content, does not require accounts, and does not retain conversation history.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement.

3. Acceptable Use

You agree NOT to use the Service to:

  • Send unlawful, harassing, defamatory, or threatening content.
  • Transmit child sexual abuse material (CSAM), incitement to violence, or content that violates the rights of any person.
  • Distribute malware, viruses, or any code intended to compromise systems or devices.
  • Attempt to circumvent security, rate limits, or anti-abuse measures.
  • Use the Service to coordinate fraud, scams, or commercial spam.
  • Reverse engineer, decompile, or interfere with the operation of the Service.

We reserve the right to terminate a session, IP, or invitation at any time, with or without notice, if we detect or are notified of abuse.

4. Content Responsibility

You are solely responsible for the content you transmit through the Service. Because messages travel peer-to-peer and we do not store them, we have no ability to retrieve, moderate, or remove past content. The Service is provided as a communication conduit only.

5. Paid Features

The Service is free for two participants. Enabling a third participant in a room costs USD 0.99, charged via Stripe at the time of upgrade. Payments are non-refundable once the third slot has been activated.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or free of errors.

While the Service uses end-to-end transport encryption (DTLS) for the WebRTC data channel, we cannot guarantee that operating system screenshots, screen recordings, third-party browser extensions, or compromised devices will not capture content outside of our control.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR USD 10, WHICHEVER IS GREATER.

8. Termination

You may stop using the Service at any time by closing the browser tab. We may suspend or discontinue the Service in whole or in part at any time without notice.

9. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this document indicates when these Terms were last revised. Continued use of the Service after a change constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of the Service is incorporated, without regard to conflict of law principles.
